California Enacts Vaccine Law That Forces Parents to Choose Between Human Rights and Civil Rights

From flash to bang, it took the politically powerful corporate, medical trade and government lobbyists just six months this year to gut the human right to informed consent to medical risk taking and the civil right to a school education in California. They did it by enacting a new law (SB 277) signed by Governor Jerry Brown on June 29, 2015 that denies parents the legal right to file a personal belief exemption to vaccination for religious and conscientious beliefs so their children can attend school.

In order to sign the bill into law, Governor Brown had to abandon his long-standing legislative record as a champion of parental and religious rights and school education. NVIC called him out in a July 1, 2015 letter for failing to protect California families from segregation and discrimination based on vaccination and health care choices that parents make in the best interest of their minor children.

Brute Political Power Wielded by Government and Industry Fast Tracks Oppressive Bill Into Law

Consistently throughout the legislative process, the numbers of California citizens testifying in opposition to the oppressive bill vastly numbered those testifying in support. The ramming of SB 277 through the California legislature despite strong public opposition was an impressive demonstration of the brute power that can be wielded by the public-private partnership between government and industry dominating the U.S. health care system in the 21^st century.

Disinformation about the measles outbreak at Disneylandand vaccine safety and effectiveness was used by mainstream media outlets to forward the forced vaccination agenda in the legislature in an attempt to neutralize the growing number of citizens standing up and defending their human and civil rights in our nation’s largest state. Even though thousands of men, women and children from all walks of life came again and again to Sacramento this year to attend public rallies and testify against SB 277 in Senate and Assembly committee hearings, the Senate voted 25 to 10 and the Assembly voted 46 to 30 to approve the legislation after contentious floor debates.

Even as he signed it, there was an apology embedded in his letter, in the form of what he deemed to be a generous medical exemption.

Fighting this bill in the 11th hour was never the endgame. This outcome has been a long time coming. And our response is just the beginning.

This is not about vaccination, public health, or children.

It is up to us to determine whether this law, and ones similar to it, will stand.

Introduction:

I’ve been dismayed by the national brouhaha characterized by the Four “Astroturf” Horsemen of Vaccine Hysteria: Fear, Anger, Blame, Hatred.

• The unvaccinated must be hunted down and punished
• Measles is deadly
• We need a federal mandate for the measles vaccine
• No exemptions for anyone

There’s nary a mainstream outlet that hasn’t jumped in and piled on. For a group of investigative journalists, health reporters, seasoned writers, and popular bloggers that claims to wrap themselves in the cloak of modern science, there’s precious little scientific or even analytic thinking, let alone responsible, measured discussion. It remains to be seen whether mainstream journalism will grow a spine.

In the meantime, however, what concerns me is how little parents know about the combination measles, mumps & rubella vaccine (MMR).

I worry about informed consent.

In Part One, we address the safety of the vaccine itself. In Part Two, we’ll investigate what’s going on with its manufacturer, Merck & Co.

Merck Won’t Disclose Mumps Vaccine Efficacy, Say Scientists Accusing Company Of Falsifying Tests

Mumps vaccine manufacturer Merck & Co. Inc. is accused in a court filing of refusing to respond to a discovery request asking for the efficacy of the mumps vaccine as a percentage, reports say. Two of Merck’s former scientists, now whistleblowers, accuse Merck of deliberately falsifying tests in order to make the mumps component of its MMRII vaccine appear more effective than it actually is.

The scientists, Stephen Krahling and Joan Wlochowski, are represented by attorneys at Constantine Cannon, and those attorneys have now “asked U.S. Magistrate Judge Lynne Sitarski of the Eastern District of Pennsylvania to compel Merck to respond to their discovery request,” according to Reuters. They say that Merck refuses to answer the question and gives the excuse that it cannot run a new clinical trial in order to be able to state the efficacy in a different way. Instead, the company is using a “cut-and-paste” method of disclosure, repeating the efficacy results in the exact same way the data was depicted a half century ago.

“Merck should not be permitted to raise as one of its principal defenses that its vaccine has a high efficacy, which is accurately represented on the product’s label, but then refuse to answer what it claims that efficacy actually is,” the letter to the U.S. Magistrate stated. The whistleblowers’ lawsuit was filed in 2010 and asserted that Merck deliberately skewed the efficacy tests by actually adding animal antibodies to the blood samples that were to be tested. The scientists assert that, because of this falsification, Merck has been able to declare that the mumps vaccine is 95 percent effective and in doing so, keep any competing vaccine manufacturers away from the market.
